In an interview with the BBC Peter Fleisch has admitted that two clauses in the privacy policy are vague.

I call them escape-like clauses although maybe that gives too much an impression of a well thought out plan.

I think they just happen to be vague. Dot.

Respecting everybody's opinions on the matter, the privacy issue with data with the current Google is getting old. It's not a problem.

Who owns Google and therefore your data, that is a problem.

I wonder if there is any legally binding way in which the current direction of the company can exclude private data from future business deals -- and if that would indeed make sense.

The fear has risen since Google's acquistion of Doubleclick.

Of course, Google takes issue with this article.
